These Terms and Conditions form the basis of the working relationship between Devoted K9 Training (“the Trainer”) and the Owner of the dog participating in the Residential Training Programme (“the Owner”).
By booking and participating in a Residential Training Programme with Devoted K9 Training, the Owner confirms that they have read, understood and accepted these Terms and Conditions and agree to be bound by them.
A booking request constitutes a request by the Owner to purchase residential training services from Devoted K9 Training. A booking shall only be deemed accepted once confirmation has been provided by Devoted K9 Training and any required payment has been received. No contract shall exist until such acceptance has occurred.
Residential training bookings may be cancelled by the Owner upon written notice. A minimum of four weeks notice must be provided prior to the commencement date of the Residential Training Programme. Where less than four weeks notice is given, no refund shall be payable and any monies paid shall be retained by Devoted K9 Training.
Any quotation or estimate provided by Devoted K9 Training shall remain valid for a period of fourteen days and shall not constitute acceptance of a booking.
Any additional costs incurred during the dog’s stay, including but not limited to veterinary treatment, emergency food supplies, medication, transportation, extended boarding, specialist equipment or other unforeseen expenses, shall remain the responsibility of the Owner and shall be payable upon request.
Devoted K9 Training follows a balanced training approach tailored to the individual needs, temperament, behaviour and training objectives of each dog.
Prior to commencement of the Residential Training Programme, the Owner shall have provided informed consent for the use of any training methods, handling techniques and training equipment deemed appropriate by Devoted K9 Training for their dog’s individual requirements.
Training equipment may include, but is not limited to, leads, long lines, retractable leads, slip leads, grot collars, prong collars, e-collars, muzzles, place boards, crates, reward-based training tools and other training aids considered suitable for achieving the agreed training objectives.
The Owner acknowledges that whilst every reasonable effort is made to ensure the dog’s comfort, welfare and safety at all times, certain training equipment may occasionally cause minor and temporary irritation, including slight skin sensitivity, coat rub, pressure marks or mild discomfort associated with normal use.
Devoted K9 Training shall take all reasonable precautions to minimise the risk of irritation or discomfort and will promptly assess and address any issues that arise to ensure the continued health and wellbeing of the dog throughout their stay.
The Owner accepts that minor and temporary irritation resulting from the reasonable and appropriate use of agreed training equipment shall not constitute negligence on the part of Devoted K9 Training where all reasonable care has been exercised.
Any concerns regarding training methods or equipment must be raised prior to commencement of the Residential Training Programme.
Devoted K9 Training shall use training methods, handling techniques and equipment considered appropriate to the individual dog and agreed training objectives.
The Owner acknowledges that dog behaviour is influenced by numerous factors including genetics, environment, health, previous learning history, consistency, management and owner compliance following completion of the programme.
Whilst every reasonable effort shall be made to achieve the agreed training objectives, no guarantee is given that any specific behavioural outcome, level of obedience, competition achievement or training result shall be achieved.
The Owner acknowledges that successful long-term outcomes require continued consistency, reinforcement and management following completion of the Residential Training Programme.
The Owner warrants that they are the legal owner of the dog and are authorised to enter into this Agreement.
The Owner further confirms that all information provided to Devoted K9 Training regarding the dog’s health, behaviour, temperament, training history and welfare requirements is complete, accurate and truthful.
The Owner agrees to immediately notify Devoted K9 Training of any changes to the dog’s health, medication requirements, behavioural history or welfare needs before commencement of the programme.
The Owner confirms that the dog is fit to participate in the Residential Training Programme and is adequately protected against transmissible diseases, parasites and infections.
During the Residential Training Programme, dogs shall reside within accommodation provided by Devoted K9 Training and shall receive daily care, supervision, training, exercise, enrichment, feeding and welfare monitoring appropriate to their individual needs.
Devoted K9 Training shall take all reasonable steps to ensure accommodation remains secure, clean, safe and suitable for the welfare needs of each dog.
During periods of rest, downtime, overnight accommodation and when not actively participating in training activities, dogs shall be housed in secure and appropriately sized crates.
The use of crates forms part of the structured training environment and is intended to encourage calm behaviour, support rest and recovery, assist with routine management and provide a safe and comfortable environment throughout the dog’s stay.
All crates utilised by Devoted K9 Training shall be selected according to the size, age, breed, temperament and individual needs of the dog.
Dogs shall receive regular exercise, enrichment activities, toilet breaks, training sessions and appropriate human interaction throughout the day.
Where a dog demonstrates significant distress or welfare concerns relating to crate use or accommodation arrangements, Devoted K9 Training reserves the right to assess whether continuation of the Residential Training Programme remains appropriate.
Owners are required to provide sufficient food for the entire duration of the dog’s stay unless alternative arrangements have been agreed in writing. Any dietary requirements, allergies, food intolerances, sensitivities, supplements or feeding instructions must be disclosed before commencement of the programme.
Where emergency food supplies are required due to insufficient food being provided, any associated costs shall remain the responsibility of the Owner.
Dogs may participate in controlled and supervised interactions with other dogs where deemed appropriate by Devoted K9 Training. Whilst all reasonable precautions shall be taken, the Owner acknowledges that interactions between dogs carry an inherent risk despite appropriate supervision and management.
The health and welfare of all dogs in the care of Devoted K9 Training shall remain the highest priority at all times.
The Owner acknowledges that some dogs may experience minor fluctuations in body weight, physical condition, appetite, muscle tone or overall fitness during the Residential Training Programme.
Such changes may occur as a result of increased physical activity, structured exercise, environmental changes, training demands, stress associated with being away from home, changes in routine, improved fitness levels, or other factors reasonably associated with participation in the programme.
Whilst Devoted K9 Training will take all reasonable steps to monitor the dog’s health, welfare, appetite and body condition throughout their stay, the Owner accepts that minor and temporary weight loss or physical changes may occur despite appropriate feeding, care and supervision.
Where Devoted K9 Training considers any change in the dog’s weight, condition or overall wellbeing to be excessive or cause for concern, appropriate action will be taken, which may include adjustment of feeding quantities, reduction of training intensity, veterinary consultation, or contact with the Owner.
The Owner must disclose any known allergies, food sensitivities, environmental sensitivities, ongoing medical conditions, medications, previous allergic reactions, veterinary recommendations or other relevant health concerns prior to commencement of the Residential Training Programme.
Where medication is prescribed, the Owner shall provide clear written instructions regarding dosage, administration requirements and known side effects.
In the event that a dog with a known severe allergy experiences a flare-up, adverse reaction or medical complication during their stay, Devoted K9 Training reserves the right to suspend or terminate the residential placement where necessary for the health, safety and welfare of the dog.
Training may resume at the earliest suitable opportunity once the dog’s condition has stabilised and it is deemed safe and appropriate to continue.
No decision to suspend or terminate a residential placement shall be made lightly and shall always be based upon the welfare needs of the dog and, where appropriate, veterinary advice.
Any veterinary costs, medication costs, transportation expenses or associated charges arising from an undisclosed medical condition, allergy or sensitivity shall remain the responsibility of the Owner.
Failure to disclose relevant medical information may result in immediate termination of the Residential Training Programme without refund where such omission poses a risk to the dog, other dogs, staff members or members of the public.
The Owner authorises Devoted K9 Training to seek veterinary treatment on behalf of the dog should illness, injury, allergic reaction or medical emergency arise during the Residential Training Programme.
The Owner shall provide details of their registered veterinary practice together with emergency contact information prior to commencement of the programme.
Where veterinary attention is required, Devoted K9 Training shall make reasonable efforts to contact the Owner’s registered veterinary practice to obtain relevant medical history, treatment information or professional advice where appropriate.
However, where circumstances require prompt assessment, diagnosis or treatment, or where the Owner’s registered veterinary practice is unavailable, Devoted K9 Training reserves the right to seek veterinary treatment from its own nominated veterinary practice or any suitably qualified veterinary professional deemed appropriate in the circumstances.
Where reasonably practicable, the Owner shall be contacted prior to treatment being authorised. However, where delay may adversely affect the dog’s health or welfare, veterinary treatment may be authorised without prior consultation.
The Owner authorises Devoted K9 Training to obtain any veterinary treatment, medication, diagnostic procedure, emergency care or other veterinary services reasonably necessary to safeguard the health and welfare of the dog.
Any veterinary fees, consultation charges, medication costs, transportation expenses, hospitalisation costs, emergency treatment fees or associated veterinary expenses incurred during the Residential Training Programme shall remain the sole responsibility of the Owner.
The Owner agrees that Devoted K9 Training shall not be liable for any injury, illness, adverse reaction or outcome arising from veterinary treatment sought in good faith and in the best interests of the dog.
The Owner confirms that they have fully disclosed all known behavioural concerns, including aggression towards people, aggression towards dogs, resource guarding, possessive behaviour, escape behaviours, separation-related behaviours, excessive fearfulness, anxiety, previous bite incidents and any incident resulting in injury to a person or another animal.
Failure to disclose relevant behavioural history may result in immediate termination of the Residential Training Programme without refund.
The Owner accepts full responsibility for any injury, damage, veterinary expenses, legal costs or losses arising from undisclosed behavioural issues.
The Owner agrees to collect their dog on the agreed collection date and time unless alternative arrangements have been agreed in writing.
Upon completion of the Residential Training Programme, Devoted K9 Training may provide a handover session explaining the training undertaken, demonstrating handling techniques and providing guidance regarding the maintenance of training outcomes.
The Owner acknowledges that maintaining the dog’s progress following collection remains their responsibility.
Failure to collect the dog on the agreed date may result in additional boarding charges being applied at the prevailing daily rate.
Residential training bookings may be cancelled by the Owner upon written notice. A minimum of four weeks notice must be provided prior to the commencement date of the Residential Training Programme. Where less than four weeks notice is given, no refund shall be payable and any monies paid shall be retained by Devoted K9 Training.
Requests to reschedule a booking should be made no less than five weeks before the commencement date unless otherwise agreed in writing.
Should Devoted K9 Training be required to cancel a booking, every reasonable effort shall be made to offer an alternative appointment of equal value and quality.
Devoted K9 Training reserves the right to terminate a residential placement where the dog’s welfare is compromised, an undisclosed medical condition becomes apparent, a severe allergy flare-up occurs, the dog develops a significant illness or injury, the dog presents an unacceptable risk to people or other dogs, inaccurate information has been provided by the Owner, or continuation of the programme is otherwise considered unsafe or inappropriate.
Where early termination occurs, the Owner shall arrange collection of the dog within the timeframe specified by Devoted K9 Training.
Unless otherwise agreed in writing prior to commencement of the Residential Training Programme, the Owner grants permission for Devoted K9 Training to photograph and record video footage of the dog for training, educational, promotional and marketing purposes.
Any request to withhold consent must be made in writing before the commencement date.
Devoted K9 Training shall process personal information in accordance with applicable data protection legislation.
Personal information supplied by the Owner shall only be processed to the extent reasonably necessary for the provision of training services, animal welfare obligations, legal requirements and associated business administration.
Devoted K9 Training shall not disclose personal information to third parties except where required by law, where necessary for the provision of services or where consent has been obtained.
Devoted K9 Training maintains appropriate public liability insurance in connection with the services provided.
The Owner acknowledges that participation in training activities, transportation, handling, exercise and interaction with other dogs carries inherent risks despite the exercise of reasonable care and supervision.
The Owner accepts such risks as part of participation in the Residential Training Programme.
The Owner acknowledges that participation in dog training and residential boarding activities carries inherent risks including illness, injury, stress, behavioural setbacks, interactions with other dogs and unforeseen incidents.
Except where liability cannot legally be excluded, Devoted K9 Training shall not be liable for any indirect, consequential or unforeseeable loss arising from the provision of training services.
The Owner agrees to indemnify and hold harmless Devoted K9 Training against any claims, losses, damages, costs or expenses arising from undisclosed behavioural issues, medical conditions, allergies, sensitivities or inaccurate information supplied by the Owner.
Nothing within this Agreement shall exclude liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability which cannot legally be excluded under the laws of England and Wales.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
